Sudbury ZBA continues 11 Allene Avenue garage permit appeal to December
SUDBURY — November 4, 2024 — Sudbury ZBA defers ruling on Allene Avenue garage permit appeal amid legal dispute over detached structures. The board on Nov. 4 continued to no later than Dec. 2 an appeal by Ava Vernooy of 17 Allene Avenue, represented by attorney Anthony J. Riley of Harrington and Heap, challenging Building Inspector Andrew Lewis's issuance of permit B-24-599 to neighbor Jeff Gray for an 865-square-foot detached garage on a 20,000-square-foot lot in a 40,000-square-foot district. Riley argued Sudbury's bylaw, unlike Gloucester's, does not extend single- and two-family non-conformity protections to accessory structures and that a variance is required; attorney Robert Dionisi for Gray countered that "residential structure" in the bylaw covers garages used in connection with a residence. Lewis told the board lot coverage rises only from 14 percent to 17.1 percent and all dimensional rules are met. The board also approved a 493-square-foot ADU at 15 Willis Lake Drive and a conditional sign permit for Wilder Companies at Sudbury Plaza, and continued variance and ADU cases at 50 Willis Lake Road and 56 Oakwood Avenue.
