Sudbury ZBA approves three permits and advances draft firearms-sales bylaw

SUDBURY — September 9, 2024 — Sudbury ZBA clears three permits and advances a firearms-sales bylaw targeting a single isolated parcel. The board voted 5-0 to grant Michelangelo Fregali a special permit (converted from a variance request) for a roofed front portico at 5 Peakham Road after Building Inspector Andrew Lewis confirmed the 1953 house already sits at roughly 33 feet inside the 40-foot front-yard setback. Members also approved Rising Sun Adult Day Healthcare Inc.'s 104-participant program at 490B Boston Post Road, with a screened-dumpster condition, and a 708-square-foot garage-and-mudroom expansion at 31 Spring Street for owners Brian Keith and Courtney Dunk. The bulk of the meeting addressed an ad hoc citizens' draft, presented by Clerk Frank W. Riepe and former Select Board member Len Simon, that would create a new IDX-1 district on the Richie & Clapper/D&D Mulch parcel as the only place a firearms business could open — "as isolated as you can get," Simon said. Chair John Riordan said a special public hearing will be scheduled within roughly three weeks. The board also recommended Associate Michael B. Hershberg for the vacant full seat, with a term expiring in 2027.
