Planning Board releases 5 Nolan Circle from covenant after lender foreclosure

SUDBURY — December 4, 2024 — Sudbury Planning Board frees first Nolan Circle lot from covenant so foreclosed lender can sell. The board voted 4-0 Dec. 4 to release Lot 1 (5 Nolan Circle) from its Form E subdivision covenant after Builder Financial and Raymond C. Green companies foreclosed Dec. 2 and recorded the deed Dec. 3. Lender Scott Poirier of Wellesley said a new purchase-and-sale is in hand for the partly built first house and the group is "working hard to put this back on track." Staff reported the in-road sediment forebay has been rebuilt with stone lining, a check dam installed between Lots 1 and 2, and the Vortechnic separator photographed clean. Lots 2 and 3 stay locked together; the subdivision and stormwater extensions expire in two weeks, with the lender expected back Dec. 18. The board also accepted a withdrawal without prejudice for 502 Concord Road and worked through line edits to a deliberately narrow ADU bylaw rewrite.
