Board releases final Nolan Circle lot despite road flaws
Sudbury's Planning Board released the final lot in the long-stalled Land in Estates subdivision despite unresolved road defects.
Planning Board · Meeting of September 9, 2026
Sudbury's Planning Board released the final lot in the long-stalled Land in Estates subdivision despite unresolved road defects. Members voted 5-0 Wednesday to approve the lot release for 21 Nolan Circle, clearing a sale that had been blocked since builder Charles Chavez took over the property and its private road under a subdivision covenant. Planning staff member Adam told the board a rough estimate put the cost at $10,000 to mill and repave patched sections near the roadway's drainage forebay if the fix fails; more than $100,000 remains on developer Poirier's bond, which the board left for a separate future vote.
Member Anuraj Shah said any road failure would likely occur "probably within two years" and recommended releasing the lot now. The board separately approved the 157 Woodside Road site plan and stormwater permit, with four new monitoring conditions, and released a bond for 7 Fox Hill Road.
