Planning Board defers Land in the Pines lot release, demands cash bond
SUDBURY — January 22, 2025 — Sudbury Planning Board defers Land in the Pines lot release pending a supplemental cash bond. ProBuilder Financial, the foreclosing lender that now owns the three-lot Nolan Circle subdivision, asked the board to release Lot 2 from its restrictive covenant so it can be sold to a builder, citing roughly $65,000 in remaining road work — primarily the final asphalt top coat — that cannot be completed until spring. Member Julie Zelermyer Perlman opposed release outright, saying the project's history showed "just having a bond in place sort of doesn't matter if there's nobody to actually do the work." Chair Stephen Garvin, joining remotely, proposed an additional cash bond on top of the existing $150,000 paper bond. Planning and Community Development Director Adam Duchesneau will work with DPW on a town-side cost estimate at prevailing wage and draft surety language for a Feb. 12 return. The board separately endorsed a draft accessory dwelling unit bylaw for the 2025 Town Meeting warrant.
